20determinante%2C%20no%20es%20tanto%20la%20ausencia%20en%20s%C3%AD%20misma%20considerada%2C%20sino%20examinar%20si%20existe%20efectiva%20desvinculaci%C3%B3n%20en%20el%20caso%20concreto.Circunstancias%20concurrentesEn%20el%20caso%20concreto%2C%20en%20el%20periodo%20de%20residencia%20a%20computar%2C%20y%20resultante%20del%20pasaporte%20aportado%2C%20se%20observan%20unos%206%20meses%20de%20ausencia%20dentro%20de%20los%20dos%20a%C3%B1os%20a%20computar.Seg%C3%BAn%20se%20argument%C3%B3%20por%20la%20solicitante%2C%20el%20domicilio%20est%C3%A1%20fijado%20en%20Espa%C3%B1a%20y%20se%20realiz%C3%B3%20un%20viaje%20a%20su%20pa%C3%ADs%20de%20origen%20por%20motivos%20de%20extrema%20necesidad%2C%20pues%20hab%C3%ADa%20perdido%20su%20trabajo%2C%20el%20padre%20de%20sus%20hijos%20no%20aportaba%20cantidad%20alguna%2C%20y%20su%20familia%20de%20Ecuador%20no%20pod%C3%ADa%20enviar%20dinero%20a%20Espa%C3%B1a%2C%20prest%C3%A1ndole%20dinero%20para%20que%20viajara%20con%20la%20idea%20de%20permanecer%20una%20temporada%3B%20nunca%20hubo%20intenci%C3%B3n%20de%20trasladar%20su%20residencia%20fuera%20de%20Espa%C3%B1a%2C%20y%20tiene%20dos%20hijos%20nacidos%20en%20territorio%20espa%C3%B1ol%2C%20el%20peque%C3%B1o%20con%20DNI%20espa%C3%B1ol%20y%20aquejado%20de%20una%20enfermedad%20por%20la%20que%20se%20le%20tratar%20regularmente%20en%20un%20centro%20hospitalario.As%C3%AD%2C%20concluye%20que%20si%20bien%20no%20hay%20plazo%2C%20ni%20normativa%20ni%20jurisprudencialmente%2C%20fijado%20para%20calificar%20la%20duraci%C3%B3n%20de%20la%20ausencia%20como%20indicativo%20de%20falta%20de%20continuidad%20y%20efectividad%20de%20la%20residencia%20legal%2C%20en%20el%20caso%20de%20autos%2C%20atendiendo%20a%20las%20particularidades%20expuestas%20en%20el%20p%C3%A1rrafo%20antecedente%2C%20el%20recurso%20ha%20de%20resolverse%20estimatoriamente%20con%20base%20a%20su%20mantenido%20arraigo%20familiar%20en%20Espa%C3%B1a%2C%20antes%20y%20despu%C3%A9s%20de%20la%20ausencia.Fuente%3A%20Diario%20la%20Ley%2004%2F07%2F17%20Autora%20Isabel%20-%20Abogada%23Abogados%20%23Extranjer%C3%ADa%20%23Nacionalidad%20%23LacaciAbogados%20...%20

%20es%20tanto%20la%20ausencia%20en%20s%C3%AD%20misma%20considerada%2C%20sino%20examinar%20si%20existe%20efectiva%20desvinculaci%C3%B3n%20en%20el%20caso%20concreto.Circunstancias%20concurrentesEn%20el%20caso%20concreto%2C%20en%20el%20periodo%20de%20residencia%20a%20computar%2C%20y%20resultante%20del%20pasaporte%20aportado%2C%20se%20observan%20unos%206%20meses%20de%20ausencia%20dentro%20de%20los%20dos%20a%C3%B1os%20a%20computar.Seg%C3%BAn%20se%20argument%C3%B3%20por%20la%20solicitante%2C%20el%20domicilio%20est%C3%A1%20fijado%20en%20Espa%C3%B1a%20y%20se%20realiz%C3%B3%20un%20viaje%20a%20su%20pa%C3%ADs%20de%20origen%20por%20motivos%20de%20extrema%20necesidad%2C%20pues%20hab%C3%ADa%20perdido%20su%20trabajo%2C%20el%20padre%20de%20sus%20hijos%20no%20aportaba%20cantidad%20alguna%2C%20y%20su%20familia%20de%20Ecuador%20no%20pod%C3%ADa%20enviar%20dinero%20a%20Espa%C3%B1a%2C%20prest%C3%A1ndole%20dinero%20para%20que%20viajara%20con%20la%20idea%20de%20permanecer%20una%20temporada%3B%20nunca%20hubo%20intenci%C3%B3n%20de%20trasladar%20su%20residencia%20fuera%20de%20Espa%C3%B1a%2C%20y%20tiene%20dos%20hijos%20nacidos%20en%20territorio%20espa%C3%B1ol%2C%20el%20peque%C3%B1o%20con%20DNI%20espa%C3%B1ol%20y%20aquejado%20de%20una%20enfermedad%20por%20la%20que%20se%20le%20tratar%20regularmente%20en%20un%20centro%20hospitalario.As%C3%AD%2C%20concluye%20que%20si%20bien%20no%20hay%20plazo%2C%20ni%20normativa%20ni%20jurisprudencialmente%2C%20fijado%20para%20calificar%20la%20duraci%C3%B3n%20de%20la%20ausencia%20como%20indicativo%20de%20falta%20de%20continuidad%20y%20efectividad%20de%20la%20residencia%20legal%2C%20en%20el%20caso%20de%20autos%2C%20atendiendo%20a%20las%20particularidades%20expuestas%20en%20el%20p%C3%A1rrafo%20antecedente%2C%20el%20recurso%20ha%20de%20resolverse%20estimatoriamente%20con%20base%20a%20su%20mantenido%20arraigo%20familiar%20en%20Espa%C3%B1a%2C%20antes%20y%20despu%C3%A9s%20de%20la%20ausencia.Fuente%3A%20Diario%20la%20Ley%2004%2F07%2F17%20Autora%20Isabel%20-%20Abogada%23Abogados%20%23Extranjer%C3%ADa%20%23Nacionalidad%20%23LacaciAbogados%20...%20
